claims under these presents.
The Resident Engineer may determine this
Agreement and his engagement thereunder at any time
by giving six months' notice in writing to the
Government but in the event of the Resident Engineer
exercising this right within three years from the date
of his arrival in the Colony he shall pay to the
Government at the expiration of such notice a sum
bearing the same proportion to the total cost of his
passage to the Colony and travelling expenses and the
expenses of and incidental to his engagement as the
unexpired portion of the said term of five years
shall bear to the whole of the said term of five years
and upon such determination the Resident Engineer
shall have no claim under this Agreement whether to
return passages or otherwise howsoever.
Notwithstanding anything herein contained the
Government may on being notified by the Engineers
so to do summarily dismiss the Resident Engineer
and determine this Agreement and his engagement
hereunder at any time in case he shall in the opinion
of the Engineers be guilty of serious insubordination
infringement of any part of this Agreement breach of
duty or misconduct in which case he shall at once
leave the works and shall not be entitled to any
compensation or damages in respect of such determina-
tion neither shall he be entitled to the homeward
passages referred to in Clause 3 hereof and he shall
forthwith vacate the building or buildings provided
by the Government
If the Resident Engineer shall
be certified by a duly qualified Medical officer
employed by the Government as being incapacitated by
